Paternity Leave Changes April 6th 2024

From April 6th 2024, Paternity Leave is set to undergo adjustments in alignment with the evolving perspectives on work-life equilibrium and gender parity.

Recently unveiled, the UK Government’s draft legislation outlines the Paternity Leave (Amendment) Regulations 2024, stated to be effective from April 6th, 2024, bringing forth several alterations concerning paternity rights.

Initially disclosed in June 2023 as part of the Government’s response to parental leave and pay consultation, these changes mirror a transforming stance on work-life balance and gender equality, paralleling the ongoing evolution of both Maternity and Paternity leave.

So, what exactly are these modifications, and what information is crucial for both employees and employers?

Changes Summarised:

The Paternity Leave (Amendment) Regulations 2024 encapsulate four key modifications:

  1. Flexible Leave Structure: Rather than taking the entire two-week entitlement consecutively, employees can now opt for separate one-week blocks.
  2. Extended Timeframe: Paternity Leave can be taken at any point within 52 weeks following the birth or adoption of the child.
  3. Reduced Notice Period: The previous 15-week notice period before the expected childbirth or adoption is now streamlined to a 28-day notice (4 weeks).
  4. Alterable Leave Dates: Dates specified for leave can be changed, provided employers are given a minimum of 28 days’ notice, offering more flexibility.

Employee Considerations:

For those contemplating Paternity Leave in the near future, these changes are applicable if the expected childbirth or adoption date is post-April 6th, 2024. These amendments aim to empower eligible fathers or partners with enhanced rights and flexibility. If pre-planned leave falls post-April 6th, individuals are advised to engage with their employer or HR department.

Employer Action:

While these adjustments impact parents with childbirth or adoption after April 6th, 2024, the regulations take effect from March 8th, leaving employers with a brief window to familiarise themselves. The Paternity Leave (Amendment) Regulations coincide with other family-related legislative shifts, emphasising the need for employers to stay abreast of these changes, including those related to flexible working, carer’s leave, and redundancy protection extension.
